On Us Free of Charge:

  • Prepare and submit for filing the Request to Set Case for Trial or Request To Enter Default Judgment.
  • Prepare and submit for filing the Judgment for Possession.

Courthouse Filing Costs

Lawsuit Court Fees [Mandatory]:

  • Initial Filing Fee of the Lawsuit: +$240-$435 payable to the Court
    • Superior Court Filing Fees for Cases Under $10K: $240
    • Superior Court Filing Fees for Cases Over $10K: $380
    • Superior Court Filing Fees for Cases Over $35K: $435

Optional Additional Fees & Costs 

Service of Process Fees [Optional]:

  • Notice: Per Service Location: +$85* (1 attempt by a registered process server. Service normally by posting and mailing. Will obtain one Proof of Service). The fee is for Routine Service and typical turn around time is 3 to 5 business days.
    • You can serve this yourself.
  • Lawsuit: Per Tenant & Per Service Location: +$85* (3-5 attempts by registered process server. Will obtain a Proof of Service of Summons for each defendant or a Due Diligence Declaration). The fee is for Routine Service and the first attempt starts 3 days from submission to Process Server and attempts over 3-4 days. Serving the lawsuit includes up to 3 attempts at the same location.
    • You can have a friend or family member serve this who is not a party to the matter.

*Rural Additional Process Server Fee: Service in remote and rural areas might have higher fees due to longer travel times.

Additional Service Provider Fees [Optional]:

  • Additional Known Tenants: Client agrees to pay +$25 fee for each additional known tenant/occupant.
  • Prejudgment Claim of Right to Possession: Service Provider charges +$65 for the preparation of this form to be served along with the filed lawsuit. 
  • Entity or Trust Plaintiff: If the property is owned by anyone other than an individual, such as a Living Trust or Corporation, a California licensed attorney is required to be on record. You can hire your own attorney or we can refer you to a Cooperating Attorney. The fee the attorney charges a flat fee of $350 for an uncontested matter and is paid directly to the attorney and you will enter into contract with that attorney.

Post Judgment of Possession [Optional]:

  • Writ of Possession & Sheriff Instructions: +198 
  • Sheriff Courier Sheriff: +$98 Service Provider charges $98 to courier the Sheriff Instructions form(s) for the Sheriff Lockout Request and the Writ of Possession along with their fee.
  • Mandatory Sheriff Lockout Fee: +$180 payable to the Sheriff
  • Writ of Possession Court Fee: +$40 payable to the Court

Tenant(s) Evading Service of Lawsuit [Optional]:

  • Order to Post and Mail (if service unsuccessful of the lawsuit): +$298
  • Service of Lawsuit by Posting – Per Tenant & Per Service Location: +$85** (1 attempt by registered process server and service conducted by posting and certified mailing. Will obtain a Proof of Service of Summons)
  • USPS Certified Mailing: +$10 plus/per mailing
  • Mandatory Court Fees: +40 payable to the court

**Rural Additional Process Server Fee: Service in remote and rural areas might have higher fees due to longer travel times.

Contested Case – Tenant Files Answer/Motion [Optional]:

  • Cooperating Attorney Representation: Average of $450/flat fee for a single appearance totaling no more than four hours, either am or pm calendar. If additional hearings are required, there will be additional fees. You will enter into contract with the attorney and the attorney will bill you separately. The fee the attorney charges may vary depending on the location of the court or circumstances.
    • You can choose to represent yourself (if not an entity).

Contested Case – Tenant Files Motion or Discovery [Optional]:

  • By quote only: Average of $350 per response.
    • You can choose to prepare them yourself (if not an entity) or hire an attorney.

*Contested means that your tenant is fighting the eviction or evading service of the filed lawsuit.
